How Does North Carolina Define “Mortgage Broker?”
North Carolina statute 53-244.030 defines a mortgage broker as any business entity who accepts an application for a residential mortgage loan, solicits a residential mortgage loan from prospective borrowers, negotiates the terms or conditions of a residential mortgage loan with prospective borrowers, issues residential mortgage loan commitments or interest rate guarantee agreements to prospective borrowers, or engages in table funding of residential mortgage loans, whether any such acts are done through contact by telephone, by electronic means, by mail, or in person with the borrowers or prospective borrowers.
How do Mortgage Brokers Apply For a License in North Carolina?
Mortgage brokers in North Carolina must navigate several steps to secure their license. Below are the general guidelines, but applicants should refer to the NMLS’s application guidelines for details on the process.
License Period – The North Carolina Mortgage Broker License expires on December 31 of each year and must be renewed before the expiration date
Step 1 – Meet the Net Worth Requirements
Applicants for the North Carolina Mortgage Broker License must have a company net worth (assets – liabilities) of at least $25,000 including evidence of liquidity in at least $10,000. Applicants must submit a financial statement verifying their net worth when submitting their license application.
Step 2 – Purchase a Surety Bond
First time applicants for the mortgage broker license must purchase and maintain a $75,000 surety bond
Step 3 – Hire a Qualifying Individual
Mortgage brokers must employ a qualifying individual who is capable of handling the day to day operations of the mortgage brokering business. The qualifying individual is responsible for the actions of the mortgage business, and must meet all of the following criteria
- Have a minimum of three years mortgage lending or brokering experience
- Has completed the required education course
- Has meet one of the following examination requirements:
- Passing results on both the National and North Carolina State components of the SAFE Test
- Passing results on both the National and Stand-alone UST components of the SAFE Test
- Passing results on the National Test Component with Uniform State Content
Step 4 – Request a NMLS Account
The North Carolina Mortgage Broker License application is submitted electronically through the Nationwide Multistate Licensing System (NMLS). To submit a license application, applicants must first request to obtain an NMLS account.

How Do North Carolina Mortgage Brokers Renew Their License?
Mortgage brokers can renew their license online through the NMLS. License holders need to simply login to their account to access their renewal application. The North Carolina Mortgage Broker License expires on December 31 of each year and must be renewed before the expiration date. When renewing their license, mortgage brokers in North Carolina will need to increase their bond amount to reflect the annual volume of mortgage loans originated, as outlined in Table 1.1.
